Difference between sequential suretyship and unconditional suretyship


Sequential suretyship: The appropriate contractual term can specify that in certain circumstances the obligee is prevented from demanding satisfaction from the surety prior to exhausting all remedies against the primary obligor. It is an artificial term.

Unconditional suretyship: The obligee has no requirement to pursue performance against the primary obligor, but it is entitled to proceed directly against the surety. In the common law, this type is simply indicated by indicating that the surety must pay ”immediately, upon first written notice”.
