Difference between rescind and cancel


The difference between the two ways of undoing a contract lies within the mutuality of the parties’ consent.
If one of the parties wishes to rescind a contract, they need either the consent of the other party or a judicial order to compel such party to do so.
By cancelling a contract, one of the party steps back from the contract without the other party’s consent. However, it is only possible in certain cases described by the law.
